Robinson & McElwee is an established leader in the fields of natural resource development, energy, and environmental law.
The firm represents clients in West Virginia state and federal courts and before the West Virginia Environmental Quality Board, Air Quality Board, Surface Mining & Reclamation Board, Oil & Gas Conservation Commission, and Shallow Gas Well Review Board. In addition to this traditional advocacy, our attorneys negotiate with the West Virginia Department of Environmental Protection on behalf of clients with interests in such matters as solid waste permits, NPDES permits, air permits, underground storage tanks (USTs), remediation standards, and enforcement actions.
The firm has been intimately involved in the development of state programs to implement federal laws such as the Clean Water Act, the Clean Air Act, the Resource Conservation and Recovery Act, Superfund legislation, and the regulation of underground storage tanks. Robinson & McElwee attorneys have also been involved in developing environmental protection programs unique to West Virgina, such as the West Virginia Groundwater Protection Act, Water Resources Protection and Management Act, and the Voluntary Remediation and Redevelopment Act.
Our energy, environment, and natural resources attorneys at Robinson & McElwee have extensive experience with the state-specific aspects of Title V permitting, New Source Review and MACT requirements, as well as land use, environmental auditing, hazardous waste regulation, water quality standards and NPDES permitting. We assist clients in the coal, oil and gas, wind power, and electric generating industries to obtain permits and comply with state and federal statutes and regulations. We respond to notices of violations and enforcement actions, and draft compliance orders.
Our attorneys advise trade associations regarding natural resources, energy and environmental matters. For example, we represent the West Virginia Manufacturers Association and the West Virginia Oil and Natural Gas Association, and we serve on the Legal Committee of the West Virginia Forestry Association.
In addition to providing legal advice, we provide legislative lobbying support on all manner of environmental and natural resources issues.
Our clients run the gamut from individual proprietors to Fortune 50 companies. These companies have interests in manufacturing, chemicals, petroleum, solid waste management, oil and gas production and transmission, coal mining, energy production and transmission, and forestry and wood products. Our energy and natural resources experience includes work siting a wind farm, multi-state electric line right-of-way negotiations, coal facility permitting, and litigation involving underground storage tanks (USTs). We have defended permits for energy-producing clients and obtained orders to pool natural gas and coal bed methane reserves. We handle all aspects of permitting and compliance activities.
